Mediation Before Discovery Completed-March 13, 2013

I just responded to a post on Mediate.com  concerning one mediator’s belief that mediation should occur before Discovery is completed.

I can’t disagree more, being both a trial attorney and a mediator.

Of course, a temporary agreement can always be negotiated, but for a final resolution of any controversy, both parties must know all the facts to achieve a fair resolution.

House Children & Family Law Committee Hearing-Feb. 17, 2013

On February 14, 2013, I attended the House Children and Family Law Committee hearing and gave testimony, as the President of the NH Guardian ad Litem Association, concerning four proposed bills concerning GALs.

Two of these bills:

would have restored the Fund which paid for GALs in family law matters when the parents could not afford to privately pay.

I supported these bills, but, because of severe financial issues affecting the judiciary, the Supreme Court and Judicial Council opposed these bills on financial grounds.

This is truly a great tragedy for the children and parents of New Hampshire that only those few parents who can afford a GAL can now have one appointed to investigate what is in the best interests of their children and advocate for this to the court.
